Terms and Conditions of Sale

1. Payment

A. 50% deposit payable upon order.
B. Balance of purchase price to be paid prior to shipping.
C. In case of cancellation there is no refund after the payment is made in full or partially. The company offers an exchange of the merchandise or its replacement prior to its usage.

2. Lucy's Inflatables , Inc. is constantly seeking ways to improve the specification; design and production of its equipment and alterations take place continually. While every effort is made to produce up-to-date literature, our brochure and / or web site should not be regarded as an exact guide to current specification, nor do they constitute an offer for sale of any particular equipment.

A. Sizes quoted are to be taken as approximations. By nature of inflatable products, it is impossible to define exact sizes, variations can occur.

3. Delivery

Delivery rates are guaranteed only on the date the quote is given , days in transit are estimated and are out of our control . The freight carrier is responsible for timely delivery of goods.

4. Risk

Risk in goods passes to the customer upon delivery; thereafter the customer shall accept all reasonable insurance for equipment.

5. Complaints

In lieu of any warranties, conditions or liabilities implied by law, our liability in respect to any defect in goods or for any loss, injury or damage attributable thereto, shall be limited to, at our option (1) the supply of new goods in exchange for defective goods or (2) repair at our facility of defective goods or (3) payment of valued of defective goods. Save as aforesaid and without prejudice thereto, we shall not be liable for consequential or other damage howsoever arising. Further, we shall not be liable (1) unless claim is detailed in writing within 12 months of Invoice date (2) to accept return of goods until we have inspected them (3) unless goods are installed and demonstrated at the time of installation by the company or installed as advised by the company. In respect that our goods include design and artistic work incapable of precise definition, our obligation to supply goods to customers is limited to supplying goods reasonable in compliance with any specification or part thereof. Further, it is understood that our goods have a limited life, the length of which is determined according to the amount of use, consequently goods used extensively will not last as long as goods used occasionally. Customer accepts that she/he has no claims by reasons of goods deteriorating through use. Play items fitted on an inflated bed are subject to abnormal wear and will not be the subject of any liability of any nature of the company.

6. Repairs

All goods returned to the company for work under guarantee or for work undertaken at the customer's request and /or at his cost shall be returned to the company in clean and dry condition properly rolled and packed. Should the company judge that the goods are not in fit condition as to cleanliness, the customer will bear all cost of putting such goods in fit condition.

7. Law

This agreement shall be made and be enforceable in the state of California.

8. Representations / Warranties

A. All new inflatables are guaranteed to be repaired within the years of warranty from the date of purchase. Shipping cost to and from Lucy's Inflatables, Inc. is to be paid by the Purchaser. All new blowers are warranted per blower manufacturer standards. All used inflatables and blowers are without warranty.
B. Any defects in Lucy's Inflatables, Inc. products resulting from negligence, improper usage or unusual wear and tear caused by excessive usage are excluded from Lucy's Inflatables, Inc. warranty coverage.
